1. ROLE OF ESEWA HOTELS AND LIMITATION OF LIABILITY
eSewa Hotels, operated as a service under eSewa, acts solely
as an online intermediary and digital facilitator, offering users a platform to
browse, select, and book accommodations listed by third-party providers. These
accommodations may include, but are not limited to, hotels, guest houses, homestays,
resorts, and other forms of lodgings ("Hotel Partners").
All descriptions, images, amenities, room types, and other
service-related information are based on data provided by the respective Hotel
Partners. eSewa Hotels does not verify the accuracy of this content and shall
not be held liable for any discrepancies, inaccuracies, or deficiencies in the
services provided by the Hotel Partner. Any issue regarding service delivery or
visual mismatch must be resolved directly between the User and the Hotel
Partner.
2. HOTEL INFORMATION AND HOTEL TERMS
Hotel booking confirmations are generated based on inventory
information shared by the Hotel Partner. eSewa Hotels shall not be held liable
for any failure by the Hotel Partner to honor the confirmed booking, provide
accommodation, or deliver agreed-upon services. In the event of denial of
check-in due to overbooking, system errors, or unavailability, eSewa Hotels
may, at its sole discretion, attempt to provide alternative accommodation
(subject to availability) or process a refund for the amount paid by the User.
Admission to hotel premises remains at the sole discretion
of the Hotel Partner. Some hotels may impose restrictions such as denying
check-in to local residents, unmarried couples, or guests failing to provide
valid identification. eSewa Hotels shall not be responsible for any such denial
of service. Refunds will not be processed in such cases.
3. USER RESPONSIBILITIES
a.
The primary guest must be at least 18 years of
age.
b.
Guests must carry and present valid
government-issued identification and address proof at the time of check-in.
c.
Users are liable for any damage (willful or
accidental) caused to the property during their stay. Compensation for such
damage is determined by the Hotel Partner, and eSewa Hotels will not intervene.
d.
Check-in and check-out times are governed by the
policies of the respective hotel. Early check-in or late check-out requests are
subject to availability and may incur additional charges.
4. ADDITIONAL CHARGES
Unless expressly mentioned at the time of booking, the
booking fee only includes the stay charges. Any additional services such as
meals, beverages, minibar usage, room service, laundry, or internet charges
will be payable directly to the hotel.
Some hotels may levy additional charges or mandatory
surcharges during festive periods (e.g., New Year, Dashain, Tihar). These
charges are non-negotiable and must be settled directly by the User with the
Hotel Partner.
5. PAYMENT TERMS
Hotel bookings on the eSewa Hotels platform may follow three
models:
a. Prepaid Model:
In this model, Users pay the full amount during booking via
eSewa. This includes the accommodation rate, applicable taxes, service charges,
and any platform convenience fees.
b. Pay at Hotel Model:
In this model, Users settle the booking amount directly with
the hotel during check-in.
c. Partial Payment Model:
In select cases, partial payments is also allowed. 30%
amount should be pre paid and remaining balance must be paid in the hotel.
Hotels may require a deposit (cash or card) during check-in
to cover incidental charges. This deposit is not connected to the booking made
through eSewa Hotels and must be settled separately.
6. TRANSACTION SECURITY
Users are required to input accurate and complete payment
details. eSewa Hotels reserves the right to cancel bookings in the event of
suspected fraudulent or incorrect payment information.
GOVERNING LAW AND JURISDICTION
These terms shall be governed by the laws of Nepal. Any
disputes arising from the use of the eSewa Hotels platform shall be subject to
the exclusive jurisdiction of the courts of Kathmandu, Nepal.
